3. Counter-Notification Procedure
If you believe that material you posted on the Service was removed or access to it was disabled as a result of a mistake or misidentification, you may submit a counter-notification. To be effective, a counter-notification must be a written communication provided to our Copyright Agent that includes substantially the following:
- Your physical or electronic signature.
- Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or the United States District Court for the Middle District of Florida if your address is outside the United States), and that you will accept service of process from the person who provided the original DMCA notice or an agent of such person.
Upon receipt of a valid counter-notification, we will forward a copy to the original complaining party. If the copyright owner does not file a court action seeking an injunction against the content within 10–14 business days, we may restore the removed material.
4. Repeat Infringer Policy
In accordance with the DMCA and other applicable laws, Fixtoprint maintains a policy of terminating, in appropriate circumstances and at our sole discretion, users or account holders who are determined to be repeat infringers. We may also limit access to the Service or terminate the accounts of any users who infringe intellectual property rights, whether or not there is repeat infringement.
